These Terms of Service ("Terms") are issued by Yimberzol Foundation ("the Foundation," "we," "us," or "our"), a not-for-profit company incorporated under Section 8 of the Companies Act, 2013. These Terms govern your use of yimberzol.org (the "Website") and record.yimberzol.org (the "Platform"), the voice data collection application for Project Zoon, an open Kashmiri speech dataset initiative (the "Project").
By accessing the Website or the Platform, and in particular by recording and submitting voice data through the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform or submit contributions.
These Terms operate alongside the Foundation's Privacy Policy, which describes how your data is collected, processed, and published. By contributing, you confirm that you have read and accepted both documents.
PART A — GENERAL TERMS (Website and Platform)
1. Use of the Website and Platform
You agree to use the Website and Platform only for lawful purposes and in accordance with these Terms. You shall not:
- interfere with, disrupt, or attempt to gain unauthorized access to the Website, the Platform, or their underlying systems;
- use automated means (bots, scrapers, or scripts) to access the Platform or submit recordings, except with the Foundation's prior written authorization;
- misrepresent your identity, age, or demographic information;
- upload or transmit malicious code or content; or
- use the Website or Platform in any manner that could damage, disable, or impair the Foundation's services or infrastructure.
2. Intellectual Property of the Foundation
All content on the Website and Platform — including text, design, logos, software, and documentation, but excluding contributor recordings — is the property of the Foundation or its licensors and is protected by applicable intellectual property law. Nothing in these Terms grants you any right to use the Foundation's name, logo, or branding without prior written consent.
PART B — CONTRIBUTOR TERMS (Platform)
3. Eligibility
Contribution through the Platform is restricted to persons eighteen (18) years of age or older. By submitting a recording, you represent and warrant that you are at least 18 years of age. Participation by minors, where undertaken, is conducted exclusively through separate, offline sessions with documented and verifiable consent from a parent or legal guardian, and is not governed by Platform onboarding.
4. Grant of Rights
By submitting a recording through the Platform, you grant the Foundation a worldwide, perpetual, irrevocable, royalty-free, sublicensable, and transferable license to:
- (a) use, store, reproduce, process, review, annotate, and modify your recordings and submitted metadata;
- (b) incorporate them into the Project Zoon dataset and any successor or derivative datasets;
- (c) publish, distribute, and make the dataset publicly available, including on third-party hosting platforms such as Hugging Face; and
- (d) license and sublicense the dataset, in whole or in part, to third parties — including for commercial use — under such dataset license terms as the Foundation may determine.
This grant is subject to the withdrawal rights set out in Section 7 and to any internal-use-only arrangement under Section 8.
5. Dataset License at the Foundation's Discretion
The terms of the license under which the dataset is published — including any conditions or restrictions on commercial use — rest at the sole discretion of the Foundation and have not yet been finalized. The Foundation intends the dataset to be openly and freely available for research, community, and non-exploitative use, and reserves the right to impose conditions on certain categories of use, including large-scale commercial use, to protect the interests of the Project and its volunteer contributors.
You acknowledge that your grant of rights under Section 4 authorizes the Foundation to select, apply, and amend the dataset license without further consent from you, and that the final license may permit third parties, including commercial entities, to use your recordings in accordance with its terms.
6. No Compensation
Contributions to the Project are voluntary. You acknowledge and agree that you are not entitled to any compensation, royalty, fee, or other payment — now or in the future — in respect of your recordings, the dataset, or any use, licensing, or commercialization thereof, unless separately agreed in writing through the Foundation's official channels.
7. Withdrawal and Deletion
7.1 Guaranteed withdrawal — within 15 days of recording
For a period of fifteen (15) days following each recording session, you may request the complete deletion of the recordings made in that session, together with their associated data, by contacting the Foundation through the channels in Section 15. The Foundation will honor such requests unconditionally.
7.2 Requests after the 15-day period
Upon expiry of the 15-day period, accepted recordings will typically have undergone review, quality assessment, and annotation by Project reviewers, and may have been integrated into curated dataset releases. Accordingly, once fifteen (15) days have elapsed from the date of a recording, the Foundation does not guarantee deletion of that recording, whether or not it has yet been published. Removal requests received after this period will be considered in good faith, but the decision to delete rests at the sole discretion of the Foundation.
Where the Foundation elects to remove published data, removal is limited to what lies within its direct control. The Foundation cannot retract copies, mirrors, forks, or derivative works — including trained models — already obtained or created by third parties, and you acknowledge that post-publication removal is necessarily incomplete.
7.3 Effect of withdrawal
Withdrawal under Section 7.1, or deletion granted under Section 7.2, terminates the license granted under Section 4 in respect of the deleted recordings, prospectively and to the extent within the Foundation's control.
8. Internal-Use-Only Arrangements
Where mutually agreed in writing through the Foundation's official email (info@yimberzol.org), the Foundation will retain a contributor's recordings and associated data for internal use only and exclude them from the published dataset. Any such arrangement must be documented prior to publication of the data concerned and supersedes the publication provisions of these Terms in respect of that contributor's data.
9. Contributor Representations and Warranties
By submitting a recording, you represent and warrant that:
- (a) the recording contains your own voice and is your original contribution;
- (b) you are at least 18 years of age;
- (c) the demographic and technical information you provide is accurate to the best of your knowledge;
- (d) your contribution does not infringe the rights of any third party, including intellectual property, privacy, or publicity rights;
- (e) your recordings contain only the text or speech requested by the Platform and do not include the voice or personal information of any other person; and
- (f) you have the legal capacity to enter into these Terms and to grant the rights in Section 4.
10. Acceptable Contribution Conduct
You shall not submit recordings that contain unlawful, defamatory, hateful, or obscene content; deliberately corrupted, silent, or non-responsive audio intended to degrade dataset quality; or material recorded from another person without their knowledge. The Foundation may, at its sole discretion, reject, exclude, or delete any contribution and suspend or terminate any contributor's access to the Platform for breach of these Terms.
PART C — LEGAL PROVISIONS
11. Disclaimer
The Website, the Platform, and the dataset are provided "as is" and "as available," without warranty of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, availability, accuracy, or non-infringement. The Foundation does not warrant that the Platform will be uninterrupted, error-free, or secure.
12. Limitation of Liability
To the maximum extent permitted by applicable law, the Foundation, its directors, officers, employees, and volunteers shall not be liable for any indirect, incidental, consequential, special, or exemplary damages — including loss of data, reputation, or opportunity — arising out of or in connection with your use of the Website or Platform, your contributions, or the publication or third-party use of the dataset. To the extent any liability cannot be excluded, the Foundation's aggregate liability shall not exceed one thousand Indian Rupees (INR 1,000).
13. Indemnity
You agree to indemnify and hold harmless the Foundation from and against any claims, damages, or expenses (including reasonable legal costs) arising from your breach of these Terms or of the representations and warranties in Section 9.
14. General
Amendments. The Foundation may amend these Terms from time to time. The "Last updated" date reflects the current version. Continued use of the Platform following the effective date of an amendment constitutes acceptance of the amended Terms. Material amendments affecting existing contributors will, where reasonably practicable, be communicated through the contact channel you have provided.
Superseding agreements. Any agreement concluded with a contributor through official channels — email, a signed or written consent form, or other documented communication — supersedes these Terms to the extent of any conflict.
Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.
No waiver. The Foundation's failure to enforce any provision shall not constitute a waiver of that provision.
Entire agreement. These Terms, together with the Privacy Policy and (upon publication) the dataset license, constitute the entire agreement between you and the Foundation concerning the Website, the Platform, and your contributions, subject to the superseding-agreements clause above.
Governing law and jurisdiction. These Terms are governed by the laws of India. Subject to any mandatory provisions of applicable law, the courts at Anantnag, Jammu & Kashmir shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.
